None appears on behalf of the Bidhannagar Municipal Corporation at the time of call.
By an order dated 21st November, 2019, the respondents were directed to file a report in the form of affidavit dealing with the averments made by the petitioner in the writ petition. No such report has either been filed or served upon the learned advocate representing the petitioner till date.
The petitioner prays for implementation of the direction given by the Commissioner, Bidhannagar Municipal Corporation in the reasoned order communicated to the petitioner by the letter dated 12th December, 2018. The said reasoned order was passed in compliance of the direction passed by this Court on 7th February, 2018 in W.P. 23162 (W) of 2017.
In the reasoned order, the Commissioner informed the petitioner that in the meeting of the Mayor-in-Council dated 28th August, 2018 it was resolved that salary of all IPP-VIII health workers engaged on a contractual basis under Bidhannagar Municipal area will be determined as per Government Order pertaining to any worker. The Corporation will not pay any additional remuneration to any worker. The policy of equal pay for equal work will be implemented henceforth. The Controller of Finance, Bidhannagar Municipal Corporation was directed to ensure that the workers engaged under IPP-VIII in the erstwhile Bidhannagar Municipality draw the same amount as their counterparts in erstwhile Rajarhat Gopalpur Municipality.
The petitioner claims that he was brought from the erstwhile Rajarhat Gopalpur Municipality and he served the Bidhannagar Municipal Corporation from March 2015 till November 2018.
The petitioner was paid remuneration at the previous rate for the aforesaid period. The petitioner claims the balance of the enhanced rate as paid to his counterpart in the Bidhannagar Municipal Corporation area.
In the absence of any report and representation from the respondents, the matter cannot be effectively dealt and decided by this Court.
Accordingly, the writ petition is disposed of by directing the Controller of Finance, Bidhannagar Municipal Corporation, the respondent No. 3 herein to verify the necessary records of the petitioner and if the petitioner is entitled to the enhanced payment for the aforesaid period, steps shall be taken to disburse the same in accordance with the reasoned order passed by the Commissioner, Bidhannagar Municipal Corporation within a period of four months from the date of communication of a copy of this order.
The petitioner shall be entitled to rely upon all documents in his support as proof of his service in the Bidhannagar Municipal Corporation for the aforesaid period.
The authority shall verify their records and take a decision in the matter within the time as specified hereinabove.
