Judgment
Manoj K. Tiwari, J
WPSS No. 2284 of 2016 filed by the petitioner was disposed of vide order dated 22.03.2018. Operative portion of the said order is reproduced below:-
"Accordingly, the writ petition is disposed of with the direction the respondent-State to issue trade certificate to the petitioner on the basis of his marks within a period of ten weeks from today and thereafter, consider the case of the petitioner for regularisation."
Alleging non-compliance of the said order, this contempt petition has been filed by the petitioner.
A response affidavit has been filed by Dr. Ahmad Iqbal, Director, Training Directorate, Uttarakhand, Haldwani, Nainital.
From perusal of para 7 of the said affidavit, this Court is satisfied that this is not a case of willful disobedience, inasmuch as, according to the opposite party, Director General, Training New Delhi has refused to sign on the National Trade Certificate of the petitioner on the ground that the Institution, from where petitioner obtained his certificate in 'Tractor Mechanic', was not affiliated with the National Council for Vocational Training. Thus, opposite party cannot be held liable for refusal on the part of Director General, Training, New Delhi.
In such view of the matter, the contempt petition is closed. Notice issued to the opposite party is hereby discharged.
