After completion of the investigation, the charge-sheet was filed. The learned trial court took the cognizance in Criminal Case No.187 of 2020 and passed the summoning order under Section 3/4 of the Dowry Prohibition Act, 1961 against the applicants – accused persons, namely, Dinesh Singh Parsara, Smt. Urmila Devi and Pradeep Singh Parsara.

The applicants - accused persons have invoked the inherent jurisdiction of this Court under Section 482 of the Code of Criminal Procedure, 1973, to quash the entire proceedings of Criminal Case No.187 of 2020, pending before the Judicial Magistrate, Dwarahat, District Almora.

Heard the learned counsel for the parties.

The applicants – accused persons, namely, Dinesh Singh Parsara, Smt. Urmila Devi and Pradeep Singh Parsara are present in-person before this Court and they are identified by Mr. K. K. Harbola, Advocate.

The private respondent no.3 Km. Deepa, the informant/victim is present in-person before this Court and she is identified by Mr. Manoj Lakchaura, Advocate.

The private respondent no.3 and all the applicants submitted that there were private disputes between them and they have resolved their disputes and after resolving their disputes they have filed a joint Compounding Application (IA No.01 of 2022) along with affidavits with their free will and without any pressure.

The private respondent no.3 Km. Deepa further submitted that she does not want to proceed with the said criminal case against the applicants.

The learned counsel for the State submitted that in the facts and circumstances of this case, the State has no objection.

On enquiry, the private respondent informed the Court that she has resolved the disputes and she does not want to proceed with the said criminal case, against the applicants.

Keeping in view of the totality of the facts and circumstances of the case, this Court is of the view that ends of justice would be met, if the entire proceedings of Criminal Case No.187 of 2020, pending before the Judicial Magistrate, Dwarahat, District Almora, are quashed.

Resultantly, the entire proceedings of Criminal Case No.187 of 2020, pending before the Judicial Magistrate, Dwarahat, District Almora, are quashed.

12.

The Criminal Miscellaneous Applications No.577 of 2022 and 1007 of 2022, filed under Section 482 of the Code of Criminal Procedure, 1973, are disposed of accordingly.
