Judgment
Neeraj Tiwari, J
Heard learned counsel for the petitioner and learned standing counsel for respondents.
Present petition has been filed seeking following relief:-
"i). Issue a writ, order or direction in the nature of mandamus directing the respondent 2 give approval which is pending for consideration before him in pursuance of letter dated 23.08.2022 of respondent no. 4 for release of petitioner's retiral dues.
ii). Issue a writ, order or direction in the nature of mandamus directing the respondents to release due retiral benefits including Gratuity, Leave Encashment and C.P.F. etc. alongwith due increments to petitioner who has retired on 31.7.2022 on attaining the superannuation."
Learned counsel for the petitioner submitted that after retirement of petitioner, his post retiral benefits are due for which Project Director, District Rural Develop Agency, Kanpur Nagar- respondent no. 4 has written letter dated 23.08.2022 to Commissioner, Rural Development, U.P., Lucknow- respondent no. 2, but till date, respondent no. 2 has not taken any decision upon that. He next submitted that a direction may be issued to respondent no. 2 to taken decision upon the letter dated 23.08.2022 written by respondent no. 4.
Learned standing counsel submitted that decision shall be taken at the earliest.
In view of the facts and circumstances of the case, the writ petition is disposed of directing respondent No. 2 to take decision upon the letter of respondent no. 4 dated 23.08.2022 in accordance with law maximum within period of four weeks from the date of submission of certified copy of this order. Petitioner is directed to annex photocopy of letter dated 23.08.2022 written by respondent no. 4 alngwith certified copy of this order. While deciding the same, respondent no. 2 shall verify about the genuineness of letter dated 23.08.2022 also from the office of respondent no. 4.
It is made clear that this Court has not adjudicated the case on merits. It is upon respondent No. 2 to pass order after considering the relevant Rules as well as facts of the case.
