Judgment
Heard learned counsel for the petitioners, learned Standing Counsel and Sri Syed Husain appearing for respondent No.2.
An effort is being made to acquire petitioners'' land inspite of the fact that part of the identical land has already been excluded from the proposal. Accordingly petitioners claim violation of Article 14 of the Constitution and relies upon AIR 2004 SC 5054, B.E.M.L. Employees House Building Cooperative Society Ltd, v. State of Karnataka and others.
Since the petitioners have already moved an application before the State Government not to acquire petitioners'' land, without entering into the merits of the matter at this stage, interest of justice will suffice if the same be considered and disposed of in accordance with law expeditiously, preferably within a period of two months from the date a certified copy of this order is served upon the authority concerned.
With these observations, with the consent of parties, the writ petition is disposed of finally.
