Instant petition has been filed assailing order dt. 04/02/2012 whereby three separate applications filed by the petitioner U/0 11, Rr.12 & 14; 0.11, R.1; & u/0 2, R.2, CPC read with 0.23, R.1, CPC & s.115 of Evidence Act came to be rejected with costs of Rs. 12,000/- . Counsel has tried to convince this Court that order of the Rent Tribunal arbitrarily rejecting all the three applications requires interference; however, after making submissions for some time, on instructions, Counsel seeks to withdraw the petition with the request to waive the costs imposed vide order impugned in the interest of justice.
Since the Counsel has confined the prayer to the extent of costs imposed vide order impugned, no interference is called for by this Court. However, in the interest of justice, this considers it appropriate to waive the costs imposed by Rent Tribunal vide order impugned. Consequently, writ petition is hereby disposed of with the modification in the order impugned dt. 04/02/2012 to the extent that the costs imposed is waived and the Rent Tribunal is directed to proceed further & expeditiously decide the matter in accordance with law.
