Dinesh vs State of Haryana

K.C. Puri, J.—Vide this order, I intend to dispose of Crl.M. Nos. M-37899 of 2010, M-37328 of 2010 and M-688 of 2011, as all these three petitions arise out of same FIR.

Petitioner-applicants Dinesh, Parmod, Mahabir and Sunil have applied for grant of regular bail in FIR No. 141 dated 17.6.2010 u/s 394 IPC, registered at Police Station P.S. Uchana, District Jind.

As per allegation of the prosecution, Sumer Singh s/o Umed Singh has stated that he is driver of Santro car No. HR-14F-1509. The accused settled a deal to book the taxi. All the four accused boarded the taxi and when they reached near the Big Canal, just ahead of village Uchana Khurd, the car was stopped by the complainant at the request of the accused. After urinating all the accused again boarded the car. The boy sitting alongwith the complainant in the front seat caught hold of him from the neck, while the boy sitting at the rear seat also caught hold of the complainant from his neck and the second boy sitting on the rear seat took up a beer bottle lying on the foot mat and hit it on his head and continue to hit the bottle on his head till it broke down. It is further alleged that after throwing the complainant out of the car the accused snatched away the car and ran away towards the side of Canal. They had also taken away the mobile of the complainant. The mobile is stated to have been recovered from Parmod-accused/applicant. Injuries are stated to have been inflicted by Dinesh-accused/applicant. The car was stated to be recovered on the same day lying abandoned.

Learned State counsel, on instructions of HC Ram Phal, P.S. Uchana, has admitted the fact that all the applicants are students of Polytechnic.

The applicants are stated to be in custody since 28.11.2010. In case they remain in jail, their career may spoil.

So, keeping in view all the circumstances, bail is granted to all the applicant-Petitioners to the satisfaction of the trial Court.
