This writ petition is filed for a direction to declare the probation of the petitioners who were serving as Assistants in the Calicut University. Learned counsel for the petitioners submits that their probation was not declared because of the pendency of WP(C)No.35638 of 2009. By order dated 8.4.2013 in this writ petition, following the interim order passed in WP(C)No.33166 of 2011, an interim order was granted directing the respondents to declare the probation of the petitioners if apart from the pendency of WP(C)No.36538 of 2009 and the interim order passed in the said writ petition, there is no other impediment in declaring their probation. It was also made clear that such declaration of probation will be subject to the outcome of WP(C)No.36538 of 2009 and further orders to be passed in this writ petition. There was also a direction to post this writ petition along with WP(C)No.33166 of 2011.
Learned counsel for the parties submits that WP(C)No.33166 of 2011 was closed by judgment dated 23.12.2022 recording the submission of the learned standing counsel for the University that the probation of the petitioners therein have already been declared and promotion granted to the petitioners. It is also pointed out by both the counsel that WP(C)No.36538 of 2009 was dismissed as withdrawn. In the light of the above facts, the interim order granted on 8.4.2013 by this Court in this writ petition is made absolute. The declaration of probation as granted by the interim order will be treated as regular and valid for all purposes.
Writ petition is accordingly ordered.
