Judgment
Arindam Sinha, J
Mr. Sahoo, learned advocate appears on behalf of petitioner and presses for hearing and order with reference to order dated 28th February, 2023. Mr. S.K. Sahu, learned advocate appears on behalf of the Commissioner, Bhubaneswar Municipal Corporation (BMC) and submits, petitioner’s father and uncle both have constructed houses with benefit under the scheme. At the time of inquiry petitioner was minor.
Paragraph-2 from order dated 28th February, 2023 is reproduced below.
Mr. Sahu, learned advocate appears on behalf of opposite party no.1 and prays for adjournment to obtain instruction. Mr. Sahoo opposes the prayer on submission, his client, being eligible, has already deposited the margin money and is entitled to the benefit. He produces original birth certificate of his client. It be kept with him for production in future, if necessary. Adjournment granted is peremptory.

BMC has not been able to demonstrate anything to the contrary.
It appears that petitioner had made representation dated 7th November, 2022 to opposite party no.1. Said opposite party is directed to consider and deal with the representation in light of aforesaid and either extend the benefit to petitioner or inform him reasons for denial thereof. Either way petitioner should be informed within three weeks of communication.
The writ petition is disposed of.
