The petitioners had filed the instant petition for grant of anticipatory bail in FIR no. 56 of 2022 for commission of offences under Section registered with Police Station Qalamabad, District Kupwara.
The Court vide its order dated 12.09.2022, had granted bail in anticipation of the arrest of the petitioners in FIR No. 56/2022 for commission of offences under Section 366 IPC.
The response has been filed by the respondents wherein they have placed on record the statement of the prosecutrix, the statement made by the prosecutrix transpires that she was abducted and raped by one
Accordingly, the interim bail granted to the petitioners on 12.09.2022 in FIR No. 56/2022 registered under Section 363, 376 and 109 IPC is made absolute on same terms and conditions.
It is, however, made clear that in the event petitioners do not participate in the investigation, the respondents shall be at liberty to lay a motion for cancellation of bail before this Court.
