The writ petition is filed to direct the first respondent to finalise the application submitted by the petitioner for regular permit on the route Edamon Sathram- Moonnumukku.
The petitioner’s case is that, he had submitted an application for regular permit before the first respondent. Subsequently, the Field Officer has submitted Ext.P1 report on 4.1.2023. In Ext.P2 proceedings, the first respondent has called for a detailed report to be placed before the first respondent before the next meeting. The stand of the first respondent is arbitrary and unreasonable. Hence, the writ petition.
Heard; Sri.O.D.Sivadas, the learned counsel appearing for the petitioner and Smt.Parvathy K., the learned Government Pleader appearing for the respondents.
The learned Government Pleader, on instructions, submitted that the first respondent has called for a detailed report from the Field Officer on finding that Ext.P1 is inadequate. The petitioner’s application will be considered in the next meeting to be convened on 19.7.2023. The first respondent would decide the application on or before 31.7.2023. The said submission is recorded.
Having considered the pleadings and materials on record and taking note of the submission made by the learned Government Pleader, in exercise of the powers of this Court under Article 226 of the Constitution of India, I dispose of the writ petition as follows:-
(i) The first respondent is directed to consider and dispose of the application purportedly submitted by the petitioner, in accordance with law and as expeditiously as possible, at any rate, on or before 31.7.2023.
(ii) I make it clear that I have not expressed anything on the merits of the application.
