This is the fifth bail application filed by the applicant under Section 439 of the Cr.P.C. for grant of bail in connection with Crime No. 01/2019 for the offences punishable under Sections 302 of IPC and under Section 30 of the Arms Act, 1959 registered at Police Station- City Kotwali District- Satna.
The applicant is in judicial custody since 28.01.2019 in the aforementioned case. The present application only prays for temporary bail for the treatment of the mother of the applicant, who is purportedly suffering from cancer. A previous application for temporary bail on the same grounds was dismissed on merits on 5-12-2020, by a co-ordinate Bench of this court.
Learned counsel for the State while opposing the application for grant of bail have submitted that the police report discloses that there are three other brothers of the applicant, who can look after the mother and the medical treatment that she has to undergo.
Under the circumstances, the application is rejected.
