The petitioner prays for grant of anticipatory bail in FIR No.0102, dated 07.06.2021, under Sections 302/148/149 of the IPC, Section 3 and 4 of SC ST Act, 1989 added later on, registered at Police Station Goindwal Sahib, District Tarn Taran.

As per case of prosecution, Jagdeep Singh has been allegedly murdered by Shubhkarmanjit Singh, Khaddi, Dilbagh Singh and Love etc.

Learned counsel representing the petitioner contends that as per the allegations in the FIR, the petitioner-Dilbagh Singh was empty handed and Khaddi had inflicted injuries to Jagdeep Singh with his knife.

Per contra, learned counsel representing the 1st informant submits that Dilbagh Singh and Love attacked the deceased with a wooden stick causing injuries on the legs of the deceased.

Mr. Amit Mehta, Sr. Deputy A.G. appearing for the State of Punjab admits that the petitioner has already joined the investigation and his further custodial interrogation is not required.

Learned counsel representing the 1st informant contends that no anticipatory bail can be granted unless the complainant is heard. It is not in dispute that he has been given sufficient hearing.

Learned counsel representing the complainant further submits that he had received threat from the petitioner-Sh.Dilbagh Singh.

Mr. Amit Mehta, Sr. Deputy A.G., Punjab, on instructions from ASI Surjit Singh, has stated that such complaint has been found false. Investigation qua various other accused has been completed whereas the police is in the process of completing the investigation against the petitioner.

Keeping in view the statement of the learned counsel representing the State of Punjab, the interim protection granted to the petitioner on 01.04.2022, is made absolute.
