Judgment

Pursuant to the Order dated 24.4.2009, the case is listed today.
In compliance with the direction given in the Order dated 24.4.2009, Awadh Kishore Singh (opposite party no. 5) is personally present before the Court, and he is identified by Sri Rajnish Kumar Srivastava, learned counsel for the opposite party no. 5.
Civil Misc. Exemption Application No. of 2009, has been filed on behalf of the said Awadh Kishore Singh. The Application is accompanied by an affidavit sworn by the said Awadh Kishore Singh on 29th May 2009.
Registry is directed to give appropriate number to the aforesaid Application.
From a perusal of the Affidavit accompanying the aforementioned Application, it is evident that compliance of the directions given in the Judgment and Order dated 18.7.2006 passed in Civil Misc. Writ Petition No. 15870 of 2002, has not been done so far.
In Paragraph3 of the said Affidavit, the said Awadh Kishore Singh has, interalia, stated that power of sanctioning the pension is given to the Deputy Director of Education.
In view of the above, the case is directed to be listed before the appropriate Bench on 13th July 2009.
On the said date, the aforesaid Awadh Kishore Singh will be personally present before the Court. Besides, notice will be issued to the present incumbent on the post of Joint Director of Education, Varanasi Division, Varanasi to be personally present before the Court on the said date.
List this case before the appropriate Bench on 13th July 2009.
