1 The learned Senior Advocates along with the briefing Advocates for the petitioner Union and respondent no.1, do not have objection if this Court

deals with this Petition.

2 The petitioner Union which espouses the cause of 30 employees purportedly working as courier boys with respondent no.1, is aggrieved by the

judgment and award delivered by the Labour Court dated 5/5/2021 vide which Reference (IT) No.09/2011 has been answered in the negative.

3 The learned Sr. Advocate for the petitioner submits that presently these 30 employees are not in employment.

4 Issue notice to the respondents, returnable on 7/3/2022.

5 The learned Advocate waives service of notice on behalf of respondent no.1. Advocate Shailesh Pathak waives service of notice on behalf of

respondent no.2.

6 Call for Record and Proceedings in Reference (IT) No.09/2011 from the Industrial Tribunal, Mumbai decided vide Award dated 5/5/2021.

7 Reply on behalf of the respondents, if any, may be filed on or before 28/2/2022.
