Heard learned Advocate Shri Sumit Prajapati for the applicant and learned APP Ms. M.D. Mehta for the respondent â€" State.

Rule. Learned APP Ms. M.D. Mehta waives service of Rule on behalf of the respondent â€" State.

By way of this application, the applicant seeks extension of parole leave granted by this Court vide order dated 06.07.2021.

Learned Advocate Shri Prajapati submits that the applicant had been released for the purpose of repairing of his house which was stated to be

damaged on account of Cyclone and whereas learned Advocate Shri Prajapati submits that for the same purpose some more time may be required

which may be granted by this Court.

Learned APP strongly opposes this application by submitting that applicant has been granted indulgence by this Court on two occasions in this very

year and hence no further indulgence may be shown. Learned APP also submits that the photographs annexed by the applicant also do not inspire

much confidence as regards the cause stated by the applicant.

Having regard to the fact that the applicant has already undergone 13 years and 05 months imprisonment and having regard to the reasons for

which the applicant had been granted parole leave vide order dated 06.07.2021, this Court is inclined to allow this application. The parole leave granted

vide order 06.07.2021 by this Court is extended for a period of one week.

It is made clear that no further extension shall be granted by this Court.

With this observation and direction, this application is allowed. Rule is made absolute.
