Dharwad Zilla General Employees Union vs Hindmatha Industries Ltd.

Aravind Kumar, J.—This application is by an employee of Hindmatha Industries Ltd., Kalalghatgi, (Company in liquidation) whereunder he is seeking the leave of the Court to come on record in CA 630/2008 as Respondent and to prosecute his claim. Admittedly Applicant is a member of Dharwad Zilla General Employees Union, Dharwad and said Union is a registered Trade Union under the Indian Trade Union Act and on behalf of its members it has already filed an application in CA 630/2008 before this Court which is pending adjudication. The cause of the employee who is now seeking to get himself impleaded is being espoused by Union and this fact is also not disputed by the impleading Applicant. In view of the same and also in view of the fact that claims of impleading Applicant, is being adjudicated by this Court in CA 630/2008 present application seeking to come on record in CA 630/2008 does not arise, particularly when it is not contended by the impleading Applicant that Trade Union which has already filed CA 630/2008 is acting detrimental to the interest of its employees. As such this application being devoid of merits is hereby dismissed.
