Judgment

The revisionist has been involved in the forest cases of Naina Range, Forest Division Nainita, there are Forest Case Nod.2/3/4/5 of 2024-25. In all these cases, the revisionist has been granted anticipatory bail by this Court. One of the conditions of the anticipatory bail is that the revisionist shall not leave the country without prior permission of the concerned court.
The wife of the revisionist Ms. Barbara Koch is a citizen of Switzerland and she is staying there only. The revisionist is travelling Switzerland to meet his wife. He sought permission from the concerned court to visit Switzerland so as to meet his wife, but his application has been rejected, by order dated 27.08.2024. It is impugned herein.
Learned counsel for the revisionist would submit that the revisionist has visa of Switzerland, which is to be renewed now and for the renewal of the spousal visa, the revisionist needs to be personally present in Switzerland, therefore, permission is sought to travel Switzerland. The travel history has been filed by the revisionist, which reveals that this year, the revisionist has been a frequent visitor of Switzerland.
Having considered, this Court is of the view that the revisionist may be permitted to visit Switzerland for four weeks on the following conditions:-
(i). That the revisionist shall file an undertaking before this court, within three days, indicating his flight details and the date of arrival in India.
(ii) If the revisionist does not file an undertaking, he shall not be allowed to visit Switzerland.
(iii) The revisionist shall make a fixed deposit amounting to Rs.20/- lakhs in the name of Registrar General of this Court and also deposit a surety of Rs.20/-lakh before the Registrar General of this Court, which should be returned to him after he comes back to his country.
(iv) That the revisionist shall not open or close any bank account overseas.
(v) That the revisionist shall not enter into any kind of property transactions abroad.
(vi) If any undertaking is not complied with the revisionist shall face such consequences as may be deemed fit and appropriate.
In view of the above, the revision stands disposed of accordingly.
