M.C. Sharma, J.—This revision petition has been filed against the order dt. 09.10.2013 passed by Sessions Judge, Jhunjhunu in Criminal Appeal No. 66/2011, whereby he dismissed the appeal filed by the petitioner and affirmed the order dt. 01.09.2011 passed by District Collector, Jhunjhunu in Case No. 93/2011, by which he allowed the application filed by Enforcement Officer under Sec. 6A of Essential Commodities Act, 1955 and confiscated the seized 55 Qtls. Gram and directed the District Supply Officer, Jhunjhunu to auction the said confiscated Gram. Without going into the merits of the case, learned counsel for the petitioner wants liberty to file a fresh application before the Collector, Jhunjhunu. He further wants that direction should be given to the Collector, Jhunjhunu to decide the said application afresh, in accordance with law.

Learned PP appearing for the State has opposed the same.

The prayer of the counsel for the petitioner seems to be genuine, hence the same is allowed. The order dt. 09.10.2013 passed by Sessions Judge, Jhunjhunu in Cr. Appeal No. 66/2011 and order dt. 01.09.2011 passed by District Collector, Jhunjhunu in Case No. 93/2011 are set-aside and the revision petition is disposed of with the aforesaid liberty and direction. Stay application also stands disposed of accordingly.
