Judgment
Heard both sides.
The writ petition is filed in the nature of Writ of Mandamus to direct the Respondents to grant permission and to provide necessary police protection to conduct the “Adal Padal” cultural programme on 09.09.2026 from 7.00 PM to 11.00 PM in the festival of Arulmigu Sri Muthumariamman Kovil at Thamarai Oorani, Panaikulam Village, Ramanathapuram District by considering the petitioner's representation dated 01.09.2026.
This is the second writ petition filed by the petitioner and he has already filed WP.Crl.(MD) No.4923 of 2026 based on the representation dated 19.08.2026 sent by Hindu Samudhaya Magajana Sabai in the village of Thamarai Oorani, wherein, there are President, Secretary and Treasurer for Hindu Samudhaya Magajana Sabai. Petitioner is one among the said villagers. In the earlier round of litigation, this Court dismissed WP.Crl.(MD) No. 4923 of 2026, on the ground that the petitioner is neither an office bearer nor authorized to file such a case. Therefore, liberty was given to the office bearers of the Hindu Samudhaya Magajana Sabai to come up with any writ petition. Instead, the petitioner sent another representation dated 01.09.2026, seeking permission for “Adal Padal” cultural programme and police protection. Having the respondent police not considered, this writ petition is filed.
The learned Counsel for the petitioner submitted that when the representation was sent and the writ petition was prepared it gave us an impression that “Adal Padal” programme is to be conducted by the villagers but later part, it was learned from the photograph, video of the past years programme that it is not the “Adal Padal” programme but only Kummi Paatu, traditional event taken place in the said festival. Therefore, he requested that instead of “Adal Padal” programme “Kummi Paatu” cultural event may be permitted to be conducted on 09.09.2026 between 7.00 PM to 11.00 PM, during the temple festival in the said Thamarai Oorani village.
In turn, the learned Government Advocate (Criminal Side) submitted that the petitioner's father Mr.Govindaraj, has given a representation dated 19.08.2026 and the same was rejected by order dated 05.09.2026 on the ground that there is a Thiyagi Immanuvel Sekaran memorial day and Pasumpon Muthuramalinga Thevar Guru Pooja during the month of September and October, 2026. Thereby, the District Collector, Ramanathapuram District issued Section 163 BNSS order (144 Cr.P.C.), from 05.09.2026 to 31.10.2026 for the entire Ramanathapuram District. Therefore, the Adal Padal programme cannot be permitted even at any rate.
By way of reply, the learned counsel for the petitioner submitted that due to mistake of facts, it was mentioned as “Adal Padal” in the representation of the petitioner dated 01.09.2026 and in the same manner writ petition was drafted. It is not the adal padal programme but only the traditional event of Kummi Paatu. Therefore, the petitioner will submit a fresh representation with the undertaking affidavit that the petitioner and his village people are only going to conduct Kummi Paatu and Mulaipaari which is the customary practice in the village.
The petitioner is directed to give such a fresh representation with an undertaking affidavit saying that there is no adal padal programme. The respondent police is directed to consider that and issue appropriate orders, granting permission to conduct the said programme and police protection at free of cost. The petitioner should not sing or display any communal song or images or words during the Kummi Paatu cultural event. In this regard, the petitioner is directed to give necessary undertaking as expected by the police.
Mr.Thirumuruga Kannan, Special Sub-Inspector of Police from the third respondent police station present here and he know the orders of this Court. Therefore, he is directed to inform the Inspector of Police of the concerned police station and the higher authorities about the Court Order which enable the higher authorities to pass suitable orders on the fresh representation and an undertaking affidavit given by the petitioner.
With the above direction, this writ petition is disposed of.
