Judgment
Petitioner has approached this Court alleging that the daughter-in-law, Megha S.Kumar, is being illegally detained by the 3rd respondent, the detenue''s mother.
Today when the matter is taken up for hearing, the detenue and the 3rd respondent are present and the 3rd respondent is represented though counsel. The 3rd respondent submits that the detenue had voluntarily come and resided with the 3rd respondent. Further we have interacted with the detenue. According to her, she has difference in opinion with the petitioner''s son and on account of various factors involved in the matrimonial issues, she is staying with the mother. Further, she submits that the petitioner had in fact forcibly asked her to go away from the matrimonial home.
Having regard to the aforesaid fact situation, we do not think that any direction as sought for is to be granted in the writ petition. The writ petition is frivolous and vexatious and has been filed only for the purpose of harassing the 3rd respondent and the detenue.
In the above circumstances, the writ petition is dismissed with the cost of Rs.5000/- to be paid by the petitioner to the 3rd respondent within two weeks from the date of receipt of a copy of this judgment.
