Judgment
Alok Singh, J.—Mr. R.S. Mittal, Sr. Advocate, assisted by Mr. Atul Gaur, Advocate, stated that Plaintiff has filed suit for recovery on the basis of several transactions. He further states that Defendants while filing the written statement have sought counter-claim inviting the Plaintiff to render the accounts. Mr. Miital, Sr. Advocate, further states that asking for the relief for rendition of accounts amounts that Defendants are admitting the transactions between the parties. Mr. Mittal, Sr. Advocate, further states that in view of the withdrawal of the relief for rendition of accounts, the transaction on which Plaintiff is banking upon stands admitted. Mr. Mittal, Sr. Advocate, further states that Plaintiff/Petitioner shall raise all the aforesaid points, including all other legal pleas available under the law, before the trial Court. With this liberty he seeks permission to withdraw the petition.
Petition is dismissed as withdrawn with aforesaid liberty.
