Dharampal vs Lalit Kumar and Others

Ram Chand Gupta, J.—The present revision petition has been filed against the judgment dated 24.05.2012 passed by learned Additional Sessions Judge, Fast Track Court, Jalandhar vide which appeal filed by the present petitioner against the judgment dated 2.05.2010 passed by learned Judicial Magistrate 1st Class, Jalandhar, was dismissed. I have heard learned counsel for the petitioner and have gone through the whole record including the impugned judgments passed by learned Courts below.

The only point argued by learned counsel for the petitioner-complainant is that evidence of prosecution was closed by learned trial Court without getting the summons served.

However, it is a State case. FIR pertains to the year 2004. Perusal of zimni orders passed by learned trial Court shows that sufficient opportunities were given to the prosecution for adducing evidence. Even 3/4 last opportunities were given by learned trial Court to the prosecution. Summons were also sent through the office of Senior Superintendent of Police. Hence, there is no force in the argument of learned counsel for the petitioner that order passed by learned trial Court vide which evidence of prosecution was closed is in any way illegal or erroneous.

Hence, in view of these facts it cannot be said that any illegality or material irregularity has been committed by both the Courts below in passing the impugned judgments, warranting interference by this Court. Hence, there is no merit in the present revision petition. The same is, hereby, dismissed.
