Petitioner is aggrieved by the final delimitation order issued by Competent Authority, whereby village Sethpur has been included in Kshetra Panchayat, Akodha Mukarratpur.
According to the petitioner, in the tentative delimitation order, the village Akodha Mukarratpur was included in Kshetra Panchayat Aithal Bujurg and since petitioner had no objection against inclusion of said village in Kshetra Panchayat Aithal Bujurg, therefore, he did not file any objection, however, in the final delimitation order, the said village has been included in some other Kshetra Panchayat, which has resulted in denial of opportunity of hearing to the petitioner.
Since final delimitation has been made and Panchayat Elections are round the corner in District Haridwar, therefore, this Court is not inclined to interfere with the matter at this stage.
However, having regard to the fact that a valuable right has been denied to the petitioner, the writ petition is disposed of with liberty to petitioner to make a representation to Competent Authority. If such representation is made, the Competent Authority shall look into the matter and pass appropriate order, in accordance with law, within a period of three weeks' from the date of receipt of representation alongwith certified copy of this order.
