Judgment
Kurian Joseph, C.J.—The writ petition is filed with the following prayers:
(i) To set aside and quash the impugned order at Annexure PA dated 28.2.99.
(ii) To direct the respondents not to recover the amount of Rs. 15247/- from the pay of the applicant and release his pay without any deduction.
(iii) To direct the respondents to await the final decision of appeal against the order of the Presiding Officer, Motor Accident Tribunal II, Kangra at Dharamshala dated 3.9.96 and if necessary, after holding regular Departmental Enquiry if found guilty of causing loss of Rs. 15,247/- to the respondent Corporation due to his negligence, to order recovery of Rs. 15, 247/- from the applicant.
It is submitted by the learned Counsel for the Corporation that this case is squarely covered by the judgment of this Court rendered in CWP (T) No. 2882 of 2008 decided on 15.12.2009. If that be so, a similar treatment shall also be extended to the petitioner herein also as extended to the petitioner in the decision, referred to above and consequential benefits, if any, shall also be disbursed to the petitioner within a period of two months from the date of production of a copy of this judgment along with a copy of the judgment, referred to above by the petitioner.
With these observations, this writ petition is disposed of, so also the pending applications, if any.
