Despite opportunities having been granted, reply to the petition has not been filed.
The controversy involved in this petition is in a narrow compass. The petitioner was an employee of the respondents /Corporation and has since superannuated. His grievance is with regard to the non release of his retiral benefits which in terms of the judgment passed by this Court in CWP No. 3050 of 2014, titled as Nek Ram Vs. State of Himachal Pradesh and others, decided on 17.07.2014 are payable to the employees of the respondents/Corporation after retirement.
As it is not in dispute that there is no other impediment in the payment of the pensionary benefits in terms of the judgment of this Court in Nek Ram's Case ( supra ) to the petitioner post superannuation, accordingly, this writ petition is disposed of with the direction that respondents/Corporation shall pay retiral benefits to the petitioner strictly in terms of the judgment passed by this Court in Nek Ram's Case ( supra ).
The petition stands disposed of in above terms, so also pending miscellaneous application(s), if any.
