The Writ Petition is filed seeking the following reliefs:

i. Call for records connecting Exts.P1 to P4 from the respondents concerned;

ii. Issue a Writ of Mandamus or such other writ, order or direction, directing the respondents 1 and 2 to re-tender in strict compliance of Ext.P-2

judgment, after issuing serving individual notice to petitioner.

iii. Issue a Writ of Mandamus or such other writ, order or direction, directing the respondents 1 and 2 to disburse EMD amount of Rs.50,000/-

deposited, vide D.D bearing No.723417 dated 24-02-2020 with 12% interest thereon to the petitioner forthwith.

iv. Such other reliefs as this Hon'ble Court may deem fit and proper; a n d

v. Award cost to the petitioner.

Sri K.R.Rajkumar, the learned Central Government Counsel, points out that retender is already conducted and work is awarded to another person.

It is also pointed out that it was not necessary to issue notice to the petitioner for retendering the cafeteria.

It is admitted by the learned counsel for the petitioner that the Earnest Money Deposit which was deposited is already refunded subsequent to the

filing of the Writ Petition. Therefore, nothing remains in this Writ Petition for consideration by this Court. If at all the petitioner is aggrieved by the

retender, he would be free to challenge the same with the proper parties on the party array.

The Writ Petition is accordingly disposed of.
