Judgment
Surjit Singh, J.—Heard and gone through the record.
Petitioner has been arrested in a case, u/s 20 of the Narcotic Drugs and Psychotropic Substances Act, alongwith one Baljeet Singh alias Bagga.
According to police record, Petitioner and his accomplice Baljeet Singh were intercepted at a place, within the area of Police Station Nirmand, and in the course of their personal search, 1 kg Charas was recovered from each of them. Petitioner applied for grant of bail to the Special Judge. His bail plea has been rejected, on the ground that his accomplice was earlier also involved in two similar cases.
Admittedly, quantity of Charas recovered from the Petitioner is less than commercial. Involvement of his accomplice in two cases of similar nature earlier could not have been a ground for rejection of his bail plea. Hence, the petition is allowed and it is ordered that the Petitioner be released, on his furnishing bail bond in the sum of Rs. 50,000/- with one surety in the like amount to the satisfaction of learned Special Judge, Kinnaur at Rampur. Petition stands disposed of.
