This petition is preferred by the petitioners seeking quashing of an FIR being C.R.No.I-150 of 2013 for the alleged offences punishable under Sections 354-D, 323, 294(b), 506(2) and 114 of the Indian Penal Code.
Since the matter is settled between the parties inter-se, the first informant - respondent No.2 herein represented through an advocate Mr.Johnsey P.Macwan, produces on record an affidavit affirmed on 21st February, 2019 by the respondent No.2 herein. The affidavit filed by Respondent No.2 herein is taken on record. Since the dispute is settled out of the Court, she has declared on affidavit that she has no objections if the present petition is allowed by quashing and setting aside the impugned FIR. She has further disclosed that, it was dispute with regard to rented property of the first informant which has now been resolved and the petitioners have vacated the said premises and waived their rights. Since the dispute between the parties is very personal in nature and it arose out of a rented property, it would in the interest of justice to quash the prosecution initiated pursuant to FIR filed by the respondent No.2 herein.
No fruitful purpose would be served if the prosecution against the petitioners is continued, more particularly when, the respondent No.2 herein, first informant, does not wish to proceed further with the said FIR.
Hence, the impugned FIR being C.R.No.I-150 of 2013 registered with Sola High Court Police Station for the alleged offences punishable under Sections 354-D, 323, 294(b), 506(2) and 114 of Indian Penal Code is hereby quashed and set aside. Rule is made absolute. Direct service is permitted.
