This writ petition has been filed by petitioners seeking a writ of mandamus commanding the respondent no.1 to consider and decide the proposal submitted by the petitioners to Director, Department of Women Empowerment and Child Development Department (Annexure No. 12 to the writ petition) before taking a final decision upon the restructuring and reconstitution of Cadre Structure of the department.
It is the case of petitioners that petitioners are working as Investigator cum Computer in the respondent-department of Women Empowerment and Child Development Department since 2006. Recently the proposal has come up from the State Government that there would be restructuring and reconstitution of the Cadre Structure in the department.
It is contended by learned counsel for petitioners that the employees of statistical cadre have submitted a proposal to Director of department, to consider their proposal for restructuring and reconstitution of Cadre Structure in accordance with the Government Orders dated 08.03.2011, 13.12.2011 and 19.07.2012, so that the cadre structure would become in a pyramidal form in the ratio of 60:40. The respondent no.3-Director has constituted a four members Committee to consider and take a decision on the proposal given by the statistical cadre on 23.07.2026. But, without any decision having been taken by the four members Committee on the proposal of petitioners for the proposal restructuring and reconstitution was forwarded to the State Government on 12.08.2026.
It is the case of petitioners that the proposal sent by them has not been considered and the matter was sent to the State Government without waiting for the report of four members Committee so constituted by the Director of department.
Learned counsel for petitioners further submits that once the proposal was sent by the department to the State Government for restructuring and reconstitution of Cadre Structure, the respondent no.1 be directed to consider the proposal submitted by petitioners, i.e. member of the statistical cadre to the Director, before taking any final decision on the restructuring and reconstitution of the cadre structure of the department.
Per contra, learned State Counsel submits that if State is directed to consider the proposal submitted by petitioners i.e. members of the statistical cadre before taking a final decision on the restructuring and reconstitution of the cadre structure in the department, that would be fair and proper.
Accordingly, the writ petition is finally disposed of. The respondent no.1-Secretary, Department of Women Empowerment and Child Development, Dehradun is directed to take into consideration the proposal submitted by petitioners i.e. members of the statistical cadre to the respondent Director-Women Empowerment and Child Development (Annexure No. 12 to the writ petition) before finally taking a decision upon the restructuring and reconstitution of the cadre structure of the entire department.
Pending application also stands disposed of.
