Judgment
Sujit Barman Roy, C.J.—On behalf of the learned Counsel for the Appellant, again a prayer for adjournment is made. I find from the order sheet that on number of occasions, the hearing of the case had to be adjourned on the prayer made on behalf of the learned Counsel for the Appellant.
This is an appeal against acquittal of the Respondents from the charges under Sections 323/149 and Sections 324/149 I.P.C. Undoubtedly the offences allegedly committed by the Respondents are of minor nature. Since the filing of the appeal in this Court, about 16 years have elapsed. The alleged occurrence took place on 3.6.1983. Since then, almost 23 years have elapsed. The offences being of petty nature and there being an inordinate delay in disposing of this appeal, I do not like to interfere with the impugned judgment of acquittal at this belated stage. I reject the prayer for adjournment and also dismiss the appeal on the aforesaid ground.
The Criminal Appeal is thus dismissed.
