Judgment
Pius C. Kuriakose, J.—In the nature of the order that we are passing in this Writ Petition, it is not necessary that we examine the merits of the grounds raised in this Writ Petition. The grievance of the petitioner/tenant is that even as R.C.A. 27/10 preferred by her against the eviction order passed by the Rent Control Court is pending before the Rent Control Appellate Authority, Kollam, the execution court has vide Ext.P5 ordered delivery. It is submitted by Sri. Vinod Bhat, the learned Counsel for the respondent that R.C.A. 27/10 has been finally heard and presently stands posted for judgment to 15/09/10. Under the above circumstances, we dispose of the Writ Petition issuing the following directions:
1) The learned Munsiff who is presently in seizin of E.P. 176/10 in R.C.P. 19/05 of Rent Control Court, Kollam is directed to keep in abeyance the order of delivery passed by him till the expiry of a period of seven days from the Rent Control Appellate Authority, Kollam delivering its judgment in R.C.A. 27/10.
