Mr. Akash Agarwal, counsel for the Applicant/Corporate Debtor is present through virtual hearing.

The above Interlocutory Application is filed by the Corporate Debtor to recall the order dated 14.02.2023 which was passed due to non-compliance of order in earlier Interlocutory Application bearing no. I.A. 313/2023 on 27.01.2023 whereunder Corporate Debtor was imposed with a cost of Rs. 10,000/- for delay in filing reply. The Applicant has to comply the conditions within one week from 27.01.2023 which was not complied. Therefore, the Tribunal has rightly confirmed the forfeiture order of Corporate Debtor’s right to file reply. Now, the Applicant mischievously filed the present application to recall the order dated 14.02.2023 purposefully to drag on the matter. The conduct of the Corporate Debtor clearly shows the lawlessness and the disrespect towards the order passed by this Tribunal. Therefore and this is not a fit case to allow the present application. Accordingly, the above application is dismissed.
