By way of present petition, the petitioners have prayed for directions to the respondents to hold meeting of Board of Directors of Himachal Pradesh State Cooperative Agriculture and Rural Development Bank Ltd. (respondent No.3) immediately and also to nominate some Directors to the Board as per the provisions.
Learned Advocate General submits that the prayer made by the petitioners has become infructuous since the respondents have already nominated the Director and other office bearers as required.
Mr.Shrawan Dogra, learned Senior Counsel, appearing for the petitioners submits that the respondents should have taken the said action immediately after the election, but they have taken over two years out of 5 years for the same, which is arbitrary.
We have heard learned counsel for the parties and gone through the record.
In view of the submission made by the learned Advocate General, the prayer made by the petitioners has become infructuous. Accordingly, the writ petition is disposed of as having become infructuous. However, it is made clear that in case any dispute is left open between the parties, the petitioners are at liberty to file necessary appeal/application/petition, if so advised.
Needless to say that whenever the law provides for nomination of Director to the Board, it shall be done at an earliest to avoid vacuum in office. Pending application(s), if any, also stand(s) disposed of.
