Judgment
We have heard learned counsel for the parties for some time.
Learned counsel for Respondent No.4 (Jai Ambe Welfare Society) should file an affidavit disclosing the members of the Society and the office bearers of the Society, audited accounts of the Society and the basis on which the Society was given permission to conduct the sterilisation camp on 2nd January, 2012 and the amount that was received by the Society as a result of the camp.
All the information mentioned above should be filed in the form of an affidavit within three weeks from today. The affidavit will also state whether the Society has any doctors as its members and whether they were involved in the sterilisation programme that was conducted on 2nd January, 2012.
Learned counsel for the State of Chhattisgarh says that the Action Taken Report on Ms. Anita Jha Commission''s report was placed before the Assembly. He says that he will inform us the latest position with regard to Ms. Anita Jha Commission''s report and its implementation. The needful be done by way of an affidavit within three weeks. The affidavit will also state the progress made in the prosecution that has been launched against the persons who are accused of having provided sub-standard medicines for the sterilisation camp.
We have requested learned Additional Solicitor General as well as Mr. Colin Gonsalves, learned senior counsel for the petitioner to sit down in the next two or three weeks and give us suggestions on how to implement the Standard Operating Procedure and the guidelines laid down by the Ministry of Health and Family Welfare, Government of India. The suggestions should be practical and pragmatic which can be enforced without much ado.
The suggestions should be filed on or before 28th April, 2016.
