Petitioner seeks restoration and continuation of the protection measures granted to him.

Learned counsel for the petitioner submits that the petitioner herein had received calls, supposedly, from Kapil Sangwan @ Nandu, a notorious and dreaded gangster. He immediately approached police and lodged a criminal case which resulted in registration of FIR. He submits that keeping in mind the gravity of the matter and the credibility of the threat, the police had granted him protection.

It is, however, submitted that protection, which had been given to him by way of providing Personal Security Officer (PSO) has been withdrawn on 25.07.2026. He submits that thereafter, he made a request to the Witness Protection Committee (WPC) of South-West District but he is not aware about the outcome thereof. He is not sure whether any decision has been taken by the Committee or not. He, however, submits that there is serious apprehension and threat to him and his family, particularly keeping in mind the reason that alleged caller is a dreaded gangster. He also submits that there was a shooting incident, around 200 mtrs. away from his home, in June, 2026 and prays for restoration of police protection.

Learned Addl. P.P. for State submits that a meeting of WPC was convened on 21.08.2026 but, somehow, he is not aware about the outcome thereof.

Keeping in mind the overall facts and circumstances of the case and to take care of requisite apprehension expressed by the petitioner herein, it is directed that the present petition would be considered as representation to the WPC, South-West District and the Committee, after seeking requisite report with respect to the threat assessment, would pass appropriate orders. Applicant herein would be permitted to participate in such meeting. Till any decision is taken by the aforesaid Committee, protection, which was earlier being provided to the petitioner, is directed to be restored.

It is, however, clarified that the aforesaid arrangement in interim in nature and the Committee would be at liberty to take appropriate decision after evaluating the threat assessment report and, therefore, the observations made hereinabove would not prejudice the Committee in any manner whatsoever.

The petition stands disposed of in aforesaid terms.

Pending application also stands disposed of accordingly.

A copy of this order be sent to learned Principal District & Sessions Judge, South-West District, concerned Chief Prosecutor, South-West District and also to the concerned Deputy Commissioner of Police, Dwarka for information and necessary action.

A copy of this order be given dasti to learned counsel for petitioner under the signatures of the Court Master.
