Judgment
V. Ramasubramanian, J.—The petitioner has come up with the above writ petition seeking a direction to the third respondent to conduct a survey and fix the boundaries in respect of his lands.
Heard Mr. Thanjai P.N. Chezhian, learned counsel for the petitioner. Mr. S. Gunasekaran, learned Government Advocate takes notice for the respondents.
The petitioner claims to be the absolute owner of the property in survey No. 71/3, Kilvalam Village, Maduranthakam, Kancheepuram District comprised of 72 cents. The said property is his ancestral property. A patta was also granted in respect of the said property. Therefore, seeking to conduct a survey and fix the boundaries, the petitioner sent a representation dated 27.6.2014 to the respondents. Since it did not evoke any response, the petitioner is before this Court.
It is settled law that if the patta stands in favour of the petitioner or the predecessor in title of the petitioner and if there are no disputes about the title or about the boundaries of the property with the neighbours, the fourth respondent can always measure the property.
Considering the limited nature of the prayer sought and without expressing any opinion on the merits of the case, the writ petition is disposed of with a direction to the fourth respondent to consider the representation of the petitioner dated 27.6.2014 on merits and if the patta stands in the name of the petitioner or the predecessor in title of the petitioner and if there are no disputes with regard to ownership, measure the land and fix the boundaries, within a period of eight weeks from the date of receipt of a copy of this order.
No costs.
