Judgment
Raja Vijayaraghavan V, J
The instant writ petition is filed seeking the following reliefs:-
(i) Issue a writ of mandamus or any other appropriate writ, order or direction directing the 1st respondent to register Ext.P6 assignment deed without insisting
production of ROR certificate, if it is otherwise in order
(ii) Issue a writ of mandamus or any other appropriate writ, order or direction directing the 2nd respondent to issue the ROR Certificate without production of the
original title document of Ext.P1 or Original Tax Receipt in respect of the property covered by Ext.P1 document.
On 17.9.2020, when this matter came up, this Court has passed the following order:-
'I have heard Sri.K.P.Harish, the learned Senior Government Pleader who submitted that the petitioner has neither presented the document to be registered before the
1st respondent nor has she taken any steps to obtain a token for online registration. If a request is made as aforesaid, there is no embargo in registering the document
in view of the judgment of this Court in Synudheen v. State of Kerala [2013 (1) KLT 221] and later in Jacob P.C. v. Village Officer, Ernakulam and Another [2020 (4)
KHC 167].
In that view of the matter, as an interim measure, I direct the petitioner herein to approach the 1st respondent and either present the document or apply for online
registration. If the request is otherwise in order, the 1st respondent shall register the document without insisting for Record of Right certificate.'
Today, when the matter was taken up, Smt.Amminikutty K., the learned Government Pleader, on instructions, submits that in terms of the directions
issued by this Court, the petitioner had appeared before the 1st respondent and the document was registered as Document No.1933/2020 of the
Edappal SRO. In that view of the matter, no further orders are required to be passed.
The writ petition is closed.
