The present interim bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with F.I.R. No.244/2023, P.S. Bhagat Ki Kothi, Dist. Jodhpur for the offences under Sections 147, 148, 149, 341, 323, 302 & 120B of IPC.
Heard representative of the petitioner and the learned P.P. present on behalf of the State. Perused the material available on record.
The instant application has been filed on the ground that the marriage of the petitioner’s brother-in-law is going to be solemnized on 10.05.2024. The presence of the petitioner is essential for the purpose of rituals, therefore, the temporary bail application filed on behalf of the applicant may be allowed.
Considering the submissions and taking a humanitarian view of the matter, this Court is inclined to grant indulgence of temporary bail to the petitioner to enable him to attend his brother-in-law’s marriage.
Accordingly, the instnat interim bail application is allowed. The petitioner shall be released on bail for a period of 20 days from the date of his actual release provided he furnishes a personal bond in the sum of Rs. 1,00,000/- along with two sound and solvent sureties in the sum of Rs.50,000/- each to the satisfaction of the Superintendent of the Central Jail, Jodhpur. The order shall be effective from the date of the petitioner's release. The concerned jail authority shall give the date of surrender to the petitioner.
