Judgment
Since the facts of the case, issue involved and the petitioner is one and the same in all these Criminal Petitions, all these Criminal Petitions are taken up together and are being disposed of by this common order.
Criminal Petition Nos.7417, 7418, 7419 and 7420 of 2021 are filed by the petitioner/A.8, under Section 482 of the Code of Criminal Procedure, 1973, seeking to quash the proceedings against him in Crime Nos.59/2021, 316/2021, 468/2020 and 421/2020 respectively, of Jangaon Police Station, Warangal District, registered for the offences punishable under Sections 379, 457 & 380 of IPC.
Heard the learned counsel for the petitioner/A.8 and the learned Assistant Public Prosecutor representing the 1st respondent-State in all these Criminal Petitions and perused the record.
Learned counsel for the petitioner/A.8 in all these Criminal Petitions would submit that there is no material evidence to connect the petitioner/A.8 with the subject crimes. The statements given by the other accused in this case are absolutely false. The petitioner/A.8 is not required for investigation in the subject crimes and ultimately prayed to allow the Criminal Petitions as prayed for.
On the other hand, the learned Assistant Public Prosecutor opposed the relief sought in these Criminal Petitions and contended that there are statements of witnesses connecting the petitioner/A.8 with the subject crimes. Huge copper wire of electric agricultural motors and electrical transformers was stolen by the accused in the subject crimes and sold to A.7, who in turn sold the same to A.8. Recovery is yet to be made. There are allegations of knowingly receiving the stolen property against the petitioner/A.8 and ultimately prayed to dismiss the Criminal Petitions.
As seen from the material placed on record, there is theft of copper wire of electric motors and electrical transformers by the accused in the subject crimes and selling the same to A.7, who in turn, sold the same to A.8. Recovery is yet to be made. Considering the totality of circumstances, the request of the petitioner/A.8 in all these Criminal Petitions cannot be acceded to. The Criminal Petitions are devoid of merit and are liable to be dismissed.
Accordingly, all these Criminal Petitions are dismissed. Miscellaneous petitions, if any, pending in these Criminal Petitions, shall stand closed.
