Judgment
Sudip Ahluwalia, J
[1]. The instant petition has been filed under Section 438 of the Code of Criminal Procedure seeking anticipatory bail in case FIR No.185 dated
14.06.2020, under Sections 34, 380, 447 and 454 of the IPC, registered at Police Station Sirsa Sadar, District Sirsa.
[2]. Ld. Counsel for the complainant has sent by e-mail an application seeking permission to place on record transcripts of the telephonic
conversations with reference to the notings in the last order; Be kept with the record, for the time being.
[3]. Heard the telephonic recordings VIS-A-VIS the transcripts of the same. It is remarkable that nowhere in the transcripts, name of any eyewitness
has been specifically disclosed. Even otherwise from the transcripts, it is seen that allegations actually are coming from the mouth of the complainant
or his wife and the alleged unnamed eyewitness(es) are basically concurring with those statements.
[4]. In the opinion of the Court, this is not a fit case warranting custodial interrogation of the petitioners, whose arrest has already been stayed earlier.
[5]. In the circumstances, the petitioners' prayer for Anticipatory Bail is allowed and they are ordered to be released on bail to the satisfaction of the
Arresting Officer till submission of report under Section 173 Cr.P.C. (Challan). They shall continue to join investigation and shall furnish an
undertaking that they shall abide by the conditions specified under Section 438 (2) Cr.P.C. Thereafter, the petitioners will be permitted to furnish bail
bonds to the satisfaction of the Ld. Trial Court.
