Judgment
Ahanthem Bimol Singh, J
[1] Heard Mr. RK Umakanta, learned GA appearing for the applicant and Mr. H. Ishwarlal, learned senior counsel assisted by Mr. Rohit, learned counsel appearing for the respondents.
[2] At the outset, Mr. H. Ishwarlal, learned senior counsel fairly submitted that if the applicant is willing to pay cost, he has no objection in allowing the condonation application.
[3] Mr. RK Umakanta, learned GA also submitted that the applicant is also ready and willing to pay cost and to hear the appeal on merit.
[4] In view of the submission made above, it is hereby ordered that the delay of 437 days in filing the connected appeal is hereby condoned subject to payment of cost of Rs. 5000/- (Rupees five thousand) to be paid by the applicant in favour of the High Court Bar Association, Manipur.
[5] Registry is directed to number the connected appeal and list it for admission hearing if the same is otherwise found in order and subject to production of proof of payment of cost.
[6] with the aforesaid directions, the present application is disposed of.
