Heard the learned counsels appearing on behalf of the parties and perused the record of the case, and in the light of the facts and circumstances and material available on record of the case, the following Issues are settled:
ISSUES
i. Whether the instant petition is maintainable in its present form ?
ii. Whether the Respondents have violated the TRAI Regulations by illegally swapping the STBs belonging to the Petitioner ?
iii. Whether the Petitioner is entitled to a decree for recovery of Rs.2,42,362/- towards outstanding dues from the Respondents jointly and severally along with the applicable interest ?
iv. Whether the Petitioner is entitled to a decree for recovery of 1702 STBs in good working condition along with all its accessories or in the alternative for a payment of Rs.34,02,298/- towards the cost of such STBs ?
v. To what other relief / reliefs the Petitioner is entitled to ?
Four weeks time is prayed and allowed to the Petitioner to file their evidence affidavits. The Respondents may file their evidence affidavits within four weeks thereafter. Let the matter be listed for "Directions" on 12th July, 2023.
