Judgment
Hon''ble Prafulla C. Pant, J.—Heard.
Applicant Deepesh, who is in jail in connection with Crime No. 150 of 2011, relating to offence punishable u/s 307, 120B I.P.C., Police Station- Kotwali Jwalapur, District Hardwar, has sought his release on bail.
Applicant is not named in the First Information Report. Three unknown persons said to have come on a motorcycle and fired shot, which caused injury on the hand of Anil Kumar (injured). Co-accused Kailash Chand, Teerath Giri Mishra and Neeraj and Ghissa Ram, have already been directed to be released on bail. No specific role is assigned to the present applicant. Learned counsel for the applicant submitted that applicant has no criminal history.
In the above circumstances, without expressing any opinion as to final merits of the case, this court is of the view that applicant deserves bail.
The bail application is allowed. Let the applicant Deepesh, be released on bail, on her executing personal bond and furnishing two sureties, each of the like amount, to the satisfaction of the Chief Judicial Magistrate, Haridwar.
