Judgment

This is the first application filed by the applicant under Section 439 of the Cr.P.C. for grant of bail.
The applicant is in custody since 04.07.2022 in connection with Crime No.410/2021 registered at P.S. Bhedhaghat, District Jabalpur for the offences punishable under Sections 420, 120-B, 34 of the IPC, 1860.
The allegation against the present applicant is that he along with other co- accused persons misused the Power of Attorney granted in his favour by the mother and defrauded her of the property in question and sold the same to his own wife and sister-in-law for a meager amount.
Learned counsel for the applicant submits that the other co-accused persons have already been enlarged on anticipatory bail by this Court with a condition of depositing Rs.33 lakhs and Rs.60 lakhs respectively before the trial Court. The applicant is ready to abide by all the terms and conditions imposed by this Court and undertakes not to pressurize the witnesses during trial; under the circumstances, he be released on bail.
Considering that the applicant is under custody for nearly a period of 45 days and he has no criminal antecedents recorded against him, this application is allowed.
It is directed that applicant be released on bail on furnishing a personal bond in the sum of Rs.5,00,000/- (Rupees Five Lakh only) with one surety in the like amount to the satisfaction of the trial Court/committal Court for his appearance on the dates given by the concerned Court. It is further directed that the applicant shall also comply with the provisions of Section 437(3) of Cr.P.C.
In case, if a complaint is received against the present applicant regarding harassment or pressurizing the witnesses during the pendency of the trial, this bail order shall stand cancelled automatically.
