Judgment
This Appeal has been filed against the Order dated 26th August, 2022 passed by National Company Law Tribunal, Indore Bench. By which Order, Section 9 Application filed by the Operational Creditor under Insolvency and Bankruptcy Code, 2016 has been admitted.
In this Appeal, an I.A. No. 3409 of 2022 has been filed by the Appellant along with which Settlement Agreement dated 10.09.2022 have been brought on record where the Appellant has settled the all dues of the Operational Creditor and has made payment of Rs. 40 Lakhs by Demand Draft.
In so far as the fee of the IRP as was directed by the Adjudicating Authority as Rs. 1 Lakh and the Expenses for Publication shall be paid by the Operational Creditor. Let IRP submit Bill of Expenses which may consist the expenses charges for the publication. The Operational Creditor shall make the payment of Rs. 1 Lakh as fee and expenses as per the Bill within two weeks from today.
I.A. No. 3409 of 2022 is allowed. Settlement Agreement is taken on record. In result, the Order dated 26th August, 2022 is set aside. The Appeal is disposed of.
