Judgment
The petitioner has filed the present writ petitions with a
grievance that the respondent - RPSC has not checked his
question No.19 of the RAS - main examination.
The petitioner has appeared in Rajasthan Administrative and
Various Subordinate Services Examination, pursuant to the
Advertisement dated 18.06.2013. The petitioner having cleared
the preliminary examination, appeared in the main examination.
On declaration of the result of the main examination, he felt
dissatisfied with his marks, and applied for obtaining copy of his
answer-sheet; on receipt of which, he was surprised to find that
his answer to question No.19 has not been checked at all and no
marks were given.
While hearing at admission stage, this Court had directed the
respondent- Commission to get the said question No.19 checked,
if not already done.
Mr. Tarun Joshi, learned counsel appearing for the
respondent-Commission apologetically submits that the
Commission has looked into the matter and has found that due to
inadvertence/technical mistake, question No.19 of the petitioner
could not be checked.
He further submits that realising this mistake, the answer-
sheet of the petitioner has been sent to the examiner and
appropriate marks has been awarded. He further informs that the
Department of Personnel has also been duly intimated/instructed
about the same.
Mr. Joshi assures that the petitioner''s revised marks would
be reckoned, while ascertaining his merit position. He also assures
that the final select-list will be issued only after considering the
petitioner''s such revised marks.
In view of above, nothing survives in the present writ
petition and the same are being disposed of with a word of caution
that the petitioner''s amended marks, given after the checking of
such unchecked question, be reckoned and the select list/merit list
be prepared accordingly.
