The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue him joining/appointment letter.
The petitioner, pursuant to Advertisement No.1/24 dated 12.02.2024, applied for the post of Constable under General Category. He successfully cleared Written Test followed by Physical Measurement and Physical Screening Test. The respondent during verification of his credentials found that an FIR No.144 dated 07.05.2024 under Sections 323, 406, 498-A & 506 of Indian Penal Code, 1860 at Police Station Sadar Hansi, District Hisar was registered against him. On account of aforesaid FIR, the respondent has refused to allow him to join.
Learned counsel for the petitioner contends that the petitioner applied for the post of Constable under General Category. At the time of filing application, no FIR was pending against him. His wife, on account of strained relations, lodged aforesaid FIR. He has cleared written and physical test, however, respondent is not issuing him appointment letter.
Learned State counsel submits that petitioner is facing trial in aforesaid FIR. The trial is at prosecution evidence stage.
Faced with this, learned counsel for the petitioner seeks permission to withdraw the petition with liberty to approach appropriate Authority or avail any other remedy as permissible by law after conclusion of trial arising out of aforesaid FIR.
Dismissed as withdrawn with aforesaid liberty.
