Judgment
This is an application for suspension of sentence imposed by the JMFC, Panaji-Goa vide its judgment and order dated 14.05.2024, wherein the Applicant has been held guilty and convicted for offence punishable under Section 138 of the Negotiable Instruments Act and sentenced to undergo simple imprisonment of six months and to pay compensation of Rs.5,00,000/- (Rupees Five Lakhs only) and in default to suffer simple imprisonment for a period of two months.
The Applicant has assailed this judgment and order vide Criminal Appeal No.181/2024 before the Additional Sessions Judge-2 at Mapusa, Goa. Vide its order dated 10.11.2025, the learned Additional Sessions Judge was pleased to dismiss the Appeal and confirm the judgment and order dated 14.05.2024, while observing that the Applicant has deposited Rs.1,00,000/- (Rupees One Lakh only) towards 20% of the compensation out of the total amount of Rs.5,00,000/- (Rupees Five Lakhs only). The order further directs the Applicant to surrender before the Trial Court and to suffer the sentence.
Mr Deepak Gaonkar, the learned Counsel for the Applicant, would submit that apart from Rs.1,00,000/- (Rupees One Lakh only), which he has deposited before the Sessions Court, on instructions, he undertakes to deposit a further amount of Rs.2,00,000/- (Rupees Two Lakhs only) within a period of four weeks from today.
In the event that such an amount is deposited, the Registry to accept the same. He submits that the Applicant is a senior citizen and prays for an order suspending the sentence.
In the circumstances, considering the aforesaid position, pending final disposal of the Criminal Revision Application, the sentence imposed by the learned JMFC vide its judgment and order dated 14.05.2024 is suspended and the Applicant is directed to be released on bail on his executing PR bond before the learned JMFC in the amount of Rs.15,000/- (Rupees Fifteen Thousand only) with one surety in the like amount to the satisfaction of the learned JMFC within a period of two weeks from today. Compliance to be reported to the Registry.
