Judgment

This is an application under Sec.439 Cr.P.C. for bail and the offence alleged is under Sec.20(b)(ii)(C) of the NDPS Act.
Heard Mr. D.R. Bhokta , learned counsel for the Petitioner as well as Miss S. Mishra, learned A.S.C. for the State-Opposite Party.
It is submitted by learned counsel for the Petitioner that the present bail application has been filed praying to release the Petitioner on interim bail on account of illness of his mother. It is further submitted that the Petitioner is inside custody since 14.1.2018 and in the meantime only 13 witnesses have been examined in course of the trial which is yet to complete.
Earlier this Court by order dated 10.4.2019 passed in BLAPL No.7184 of 2018 has directed to complete the trial by end of July, 2019.
After hearing learned A.S.C. and considering the period of detention of the Petitioner inside custody and the delay in completion of trial, it is directed to release the Petitioner on interim bail for a period of two months from the date of his release in connection with Choudwar P.S. Case No.15/2018 corresponding to G.R. Case No.01/2018 on such terms and conditions to be fixed by the learned 1st Addl. Sessions Judge, Cuttack as he deems just and proper.
It is made clear that the Petitioner shall surrender himself on or before 24th January, 2022 before the learned trial court, failing which, the trial court shall take all appropriate steps including issuance of NBW to apprehend the Petitioner.
The BLAPL is accordingly disposed of.
An urgent certified copy of this order be issued as per rules.
